Halle Berry firing back amid her ongoing battle against him Olivier Martinezclaiming that her ex-husband has tried to turn their 13-year-old son, Maceo, against her.
On Thursday, October 1, Martinez, 60, reportedly obtained a temporary domestic violence restraining order against Berry, 60, on behalf of herself and their son. He also sought to change his and Berry’s 50-50 custody agreement to a “no contact order” that prevents his ex-wife from contacting Maceo until a court hearing can be held.
At the heart of their latest dispute is an incident that Martinez said happened on September 26. Maceo reportedly sent an emergency call to his father, asking to be picked up from Berry’s home. According to a legal filing in Los Angeles Superior Court, obtained by UsMartinez’s lawyers claim that the boy was “physically assaulted” and “choked” by his mother during an argument.
Berry is now trying to fight Martinez’s restraining order, which she says prevented her from having contact with Maceo on Monday, October 5 – the child’s 13th birthday. The star has since asked the court to reinstate the previous 50/50 custody agreement.
“This case is not about domestic violence. This is a case about a mother’s unwavering love for her son, her relentless fight for his success, and her continued efforts to implement emergency interventions for his well-being over the constant interference and interference of a father who cannot separate his own self-serving interests from the welfare of the minor child,” her lawyers wrote in documents obtained by Us.
The legal representative of the actress continued, “Instead of focusing on Maceo’s urgent needs, Olivier has once again accepted accusations that distracted him from the previous interventions that the Court found him to be interfering with after which Olivier was allowed.”
Berry’s legal team said the “horrific, false and misleading” allegations in the French actor’s temporary restraining order petition prevented her from “calling, texting or otherwise contacting Maceo to wish him ‘Happy Birthday'” unless she could see him in person.
“The harm that comes from these orders extends far beyond a missed birthday. Halle is fighting to preserve her relationship with Maceoa. “Every day that these restrictions remain in place risks irreparable damage to that relationship and reinforces the false narrative that Halle did something wrong – which she did not as proven by video evidence and witness accounts.
Berry suggested that her ex-husband’s request for a restraining order was part of his attempt to turn their son against her. Additionally, she accused her ex of refusing to “treat Halle [visitation] time” as well as “continued unilateral decisions for Maceo” and “withholding information from Halle related to Maceo. “
According to Berry, Martinez has allegedly become involved in “Maceo’s therapy” and has refused to “follow Maceo’s therapist’s recommendations.”

She asked a California Superior Court judge to “rescind enforcement of the existing order” that provides “joint authority over Maceo’s mental health and educational decisions” and instituted “a long-standing 2-2-5 physical custody schedule.” (Berry’s lawyers accused Martinez of leaving key information about her “bonding authority” over Maceo’s care out of his own petition.)
Berry’s claims differ from Martinez’s Sept. 26 allegations. In his court petition, Martinez said that Maceo was “panicking” and that he heard Berry “still yelling at him in the background” during their phone call.
“When I arrived [Berry] only came out of the house [her] the partner helped our son carry his bags to my car,” Martinez said in his legal declaration.
Martinez suggested his son was “frustrated” by the alleged incident and “didn’t want to spend time” at Berry’s house. He said Berry had previously submitted Maceo in a “catch throw” while he was training in “mixed martial arts”.
The Oscar-winning actress’ lawyer Marina Beck previously called Martinez’s allegations “completely worthless and deliberately false” in a statement to us.
Berry disputed her ex-husband’s statement in court documents Monday, calling for “video evidence, eyewitness testimony, documentary evidence and subsequent conduct of the parties” to prove it false.
“Context is important here because it reveals the strategic and duplicitous nature of Olivier’s claim,” her lawyers wrote in court documents. “The DVRO process exists to protect real victims against imminent harm, not to give lawyers a tactical advantage in ongoing custody disputes. At the very moment Halle was preparing to enter orders that Olivier was violating, including orders granting her bond authority over Maceo’s mental health and educational needs, Olivier retained his fourth attorney and, one day after that, the alleged incident took place.
Berry categorically denied Martinez’s previous acts of physical abuse.
“As we often do, Maceo and I then began to roughhouse. I put my arms around his waist, in an attempt to get my phone back and we engaged in the same kind of fun wrestling that has happened several times before without incident. “As we played, I never placed[d] my hands around Maceo’s neck, I never choked him, I didn’t stop his breathing, I didn’t tell him to throw out, or I shouted, ‘Who is in control now?’ as Olivier, who was not there, falsely claims. After the fun ended, Maceo got unexpectedly upset and pushed me hard, something he had never done before. “
Berry accused Martinez of “quietly preparing[ing] in the shadows to plead unknowingly” rather than “communicating concerns, seeking cooperation, or pursuing an overt purpose.”
“Olivier and his new lawyer quietly prepared in the shadows for a no-show plea while allowing Maceo to remain in Halle’s care,” Berry’s legal team said. “The timing, negligence and surrounding circumstances underscore that this filing was not driven by an urgent concern for Maceo’s safety, but by a desire to advance Halle’s enforcement efforts, avoid investigation into Olivier’s non-compliance, and gain a strategic advantage in the parties’ ongoing dispute over Maceo’s custody.”
Entertainment every week report that Martinez objected to an immediate response by the court, requesting that Berry’s requests be dismissed.

Berry and Martinez dated for three years before marrying in 2013. After splitting in August 2015, they spent the better part of eight years fighting over custody arrangements before their divorce was finalized in August 2023.
