Don’t be tired alum Kim Zolciak15 year old son Kroy “KJ” Jagger Biermann Jr. has been under the microscope since his arrest in August after being charged with aggravated sodomy and aggravated sexual battery.
While he was released from prison and began to be arrested at Kim’s home, there were no updates on the case until this morning.
According to Page Six, KJ has officially pleaded not guilty to all seven felony charges in his sexual battery and sodomy case. Those charges included aggravated child endangerment, aggravated sodomy, aggravated sexual battery, false imprisonment, and three counts of aggravated sexual battery against a child under the age of 16.
Jason Sheffieldthe attorney representing KJ, filed the documents in court Monday and told the presiding judge that KJ was pleading not guilty to all counts in the Georgia grand jury indictment.
He also said that KJ had canceled a formal settlement that was scheduled to take place next Wednesday, and he requested that a hearing date be set for KJ’s case to be transferred to juvenile court before pre-trial and trial dates were set in the high court.
The judge also approved the sealing of documents in three “envelopes,” but, as Page Six reported, the filing did not detail the documents and envelopes.
TMZ first obtained court documents from Aug. 21, in which a sexual assault was reported on April 24 at North Fulton Hospital, where KJ’s daughter went to school with her father, telling police that it happened to KJ the day before.
The girl said that she and KJ were spending time together at the gym, and eventually they went into a shared sauna, where she said he got a hand.
While the girl noted that she tried to tell KJ, “No,” she said he wouldn’t stop and allegedly mouthed into his pen and entered her vagina digitally.
After an investigation, law enforcement contacted KJ’s father, Croy Biermannon May 14 and spoke to him on May 18.
Kroy, 41, said he would discuss the matter with Kim, 48.
The police report noted that the girl was last examined at the hospital, but the doctors did not find any male DNA in her mouth or vagina.
On August 17, KJ was officially arrested, and on August 21, Kim told Us Weekly she was defending her son.
“The allegations that are being made against my son are not at all frivolous and very troubling. He certainly denies being involved with this woman or engaging in the behavior she said,” she said at the time. “My son voluntarily took a polygraph examination on these allegations and passed. Additionally, an investigation was conducted, and no DNA belonging to my son was found.”
“False allegations can have a devastating effect not only on the accused, but also on the survivors of sexual assault and abuse. All legitimate allegations deserve to be taken seriously and investigated based on the facts and evidence. “We remain confident that the facts and evidence will establish the truth, and we ask that people allow due process to take its course rather than spreading unfounded allegations confirmation.”
So far, Kim and her family have not commented on KJ’s innocent plea.
